Licence fees and costs

The Labour Hire Licence Act 2018 (the LHL Act) and the Labour Hire Licensing Regulations 2018 (the LHL Regulations) provide for the following fees:

  • application fee– a fee to apply for a licence
  • annual licence fee – a licence fee that is paid when a licence is granted and at the start of each 12 month period after that
  • renewal application fee – a fee to apply to renew a licence upon the expiry of an existing licence
  • application to vary a licence fee – a fee to apply to vary a licence
  • certified copy or extract of the Register fee - a fee to order a certified extract or copy of the Register of Licensed Labour Hire Providers.

The table below sets out a summary of the licensing fees in Australian dollars for  the 2018-19 financial year. The fee amounts are tiered, depending on the annual turnover of the applicant or licensee.

Fees are automatically indexed for inflation on 1 July every year.

(Annual turnover is defined in clause 3 of the LHL Regulations. Annual turnover means the total ordinary income that is derived in the course of running a business.)

Tier 1, 2 and 3 businesses are defined in the LHL Regulations. You are advised to carefully review your business’s individual circumstances in relation to these definitions, but generally the fee ‘tier’ is dependent on:

  • if the applicant is an existing business –  the turnover for the business in the previous financial year; or
  • if the applicant is a new business – the projected annual turnover of the business in this financial year and in the next financial year.

Application fee

An application fee needs to be paid when you apply for a licence. This fee will not be refunded in the event the application is withdrawn or is unsuccessful.

Application fees are set out in the LHL Regulations made under the LHL Act and may change from time to time.

For the purposes of sections 17(6) and 24(1)(d) of the LHL Act, the prescribed application fee is as follows—

(a)          for a tier 1 business—108 fee units;

(b)          for a tier 2 business—288 fee units;

(c)           for a tier 3 business—532 fee units.

From 1 July 2018 to 30 June 2019 the value of a fee unit is $14.45.

Payments can be made by Visa or Mastercard.

Annual licence fee

An annual licence fee will be payable when the licence is specified to come into force, then each year in the 6-week period preceding the anniversary of that date.

For the purposes of section 35(1) of the LHL Act, the prescribed annual licence fee is as follows—

(a)          for a tier 1 business—75 fee units;

(b)          for a tier 2 business—200 fee units;

(c)           for a tier 3 business—368 fee units.

From 1 July 2018 to 30 June 2019 the value of a fee unit is $14.45.

Payments can be made by Visa or Mastercard.

If your application is successful, you will be granted a licence that remains in force for up to three years.

Renewal application fee

A renewal application fee must be paid when you apply to renew a licence upon the expiry of an existing licence.  This fee will not be refunded in the event the application is withdrawn or is unsuccessful.

Renewal application fees are set out in the LHL Regulations made under the LHL Act and may change from time to time.

For the purposes of sections 28(2)(b) and 29(1)(d) of the LHL Act, the prescribed fee is as follows—

(a)          for a tier 1 business—108 fee units;

(b)          for a tier 2 business—288 fee units;

(c)           for a tier 3 business—532 fee units.

From 1 July 2018 to 30 June 2019 the value of a fee unit is $14.45.

Payments can be made by Visa or Mastercard.

Application to vary a licence fee

Pursuant to section 38(4)(b) of the LHL Act a fee will usually be payable to the Labour Hire Authority (the Authority) where a licensee requests a substantive change to their licence, such as adding or removing a nominated officer or other relevant person.

Licensees will be able to edit some simple information, for example, contact phone numbers, through their Labour Hire Licensing Online (LHLO) account on the Authority’s website.

Pursuant to clause 22 of the LHL Regulations, the fee to apply to vary a licence fee is 10 units. Until 30 June 2019 this fee will be $144.50, unless exceptional circumstances apply.

Certified copy or extract of the Register fee

Pursuant to section 48(5) of the LHL Act, a person may obtain a certified extract from, or a certified copy of, the Register of Licensed Labour Hire Providers on payment of the fee prescribed by the Regulations at clause 25.

From 1 July 2018 to 30 June 2019, the fee is 1 fee unit, or $14.45, plus 50 cents for every page in excess of 20 pages, unless exceptional circumstances apply. If you would like to discuss your circumstances with the Authority, please contact us.
