Criminal charges for director who allegedly knowingly provided false or misleading information to LHA

The Labour Hire Authority (LHA) has filed four criminal charges against a company director for allegedly providing information he knew to be false or misleading to support his labour hire licence application.
Broadly, LHA’s action in the Dandenong Magistrates Court alleges that Korb Tin:
- falsely advised LHA that he was not involved in another labour hire business
- supplied a false invoice to support a licence application
Providing false or misleading information to an inspector or to LHA is a criminal offence under the Labour Hire Licensing Act 2018 (Vic), carrying maximum penalties per charge of more than:
- $29,000 for an individual
- $148,000 for a company.
LHA alleges that Mr Tin repeatedly breached the Act over a number of months – in his original licence application and in subsequent responses to LHA requests for information and declarations.
March 2022 |
Mr Tin applied for a labour hire licence for his business KSK Pty Ltd, listing himself as a nominated officer. While the application was being assessed, LHA alleges Mr Tin falsely advised LHA he was not involved in a separate labour hire business. |
December 2022 |
LHA alleges Mr Tin then provided information to LHA that he knew to be false or misleading when he accounted for his involvement with the separate labour hire business. |
February 2023 |
In the licence application for KSK, Mr Tin allegedly supplied a false invoice. |
Recent enforcement outcomes
- LHA continues to deliver significant enforcement outcomes, including several recent prosecutions:
- In December 2024, Nirrorn Labour Pride Pty Ltd and its director were issued penalties totalling $287,500 for failing to comply with licence obligations.
- In September 2024, Monorom Labours Power Pty Ltd and two directors were issued penalties totalling $263,889 for failing to comply with licence obligations.
- In September 2024, the Supreme Court of Victoria issued a total of $759,674 in penalties to five construction companies and three company directors for their involvement in unlicensed labour hire operations in the construction industry.
